Regarding the Court's Dismissal of the Immediate Appeal by Mr. Nozoe, Former President

June 18, 2010

The Tokyo High Court concurred with the district court by rejecting Mr. Nozoe's argument that his resignation was invalid because it was made in error or that it should be nullified for reasons of fraud, and fully validated the company's assertions in this case.

The Japanese courts have now twice rejected Mr. Nozoe's allegations, and in doing so have proved that the company's actions concerning Mr. Nozoe's resignation were appropriate. The company considers these court decisions to be a successful result for the company.
