Fujitsu Prevails in Patent Litigation Against Nanya Technology

Tokyo, May 14, 2008

Fujitsu Limited today announced that Nanya Technology Corporation Japan has withdrawn its appeal against a Tokyo District Court ruling which found that Nanya Technology infringes a Fujitsu patent.

With the withdrawal on May 13, 2008, the decision of the Tokyo District Court on August 30, 2007 becomes final and non-appealable.

In its decision, the Tokyo District Court found that Fujitsu’s patent is valid and is infringed upon by DRAM products sold by Nanya Technology Corporation Japan, a subsidiary of Taiwanese semiconductor manufacturer Nanya Technology Corporation. The Court granted an injunction against future import and sales of the infringing products and ordered the disposal of the infringing products, as well as granted compensation for past infringement.
